1. Acceptance of Terms

By accessing, browsing, or otherwise using this website in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Marketcall Inc. ("Company," "we," "us," or "our"), the operator of HealthPro Matcher.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the website following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the website.

2. About the Service

HealthPro Matcher is a free online matching service operated by Marketcall Inc. that connects consumers with independent, third-party dental and rehabilitation providers. When you submit a request through this website, we use the information you provide to help connect you with providers who may be able to assist with the type of care you are seeking.

Important: HealthPro Matcher is not a dental office, treatment center, medical clinic, or health care provider. We do not provide medical, dental, clinical, or any other professional health care advice, diagnosis, or treatment. We do not employ, control, or supervise any provider, and we do not perform, arrange, or oversee any care.

We do not guarantee, warrant, or make any representation regarding the quality, safety, suitability, availability, credentials, or outcome of any provider or the services they offer. Being matched with a provider is not an endorsement or recommendation of that provider. It is your responsibility to independently verify that any provider you engage holds the licenses, certifications, and credentials appropriate for your needs before receiving any services.

3. Eligibility

To use this website and submit a request through our service, you must:

  • Be at least 18 years of age;
  • Be a legal resident of the United States;
  • Have the legal capacity to enter into a binding agreement under applicable law; and
  • Not be prohibited from using this website under any applicable federal, state, or local law or regulation.

By using this website, you represent and warrant that you meet all of these eligibility requirements. We reserve the right to refuse service to any person who does not meet these requirements or for any other reason at our sole discretion.

You understand and agree that:

  • Your consent to receive these communications is not a condition of purchasing or receiving any goods or services;
  • Message and data rates may apply, and message frequency may vary;
  • You may revoke your consent to receive telephone or text communications at any time by following the opt-out instructions provided (for example, replying STOP to a text message) or by contacting us at info@healthpromatcher.com.

5. No Professional Advice; Not Emergency Services

The content on this website — including provider listings, articles, and other materials — is provided for general informational purposes only and does not constitute medical, dental, clinical, psychological, legal, or any other professional advice. Nothing on this website creates a doctor-patient, dentist-patient, or provider-patient relationship. When you are connected with a Third-Party Provider, that provider's own terms and privacy policy govern your relationship with them.   • Your use of the website, including any data or content you transmit;
  • Your interactions with, or receipt of services from, any Third-Party Provider;
  • Your violation of any rights of a third party, including intellectual property or privacy rights;
  • Your violation of any applicable federal, state, or local law or regulation; or
  • Any false, inaccurate, or misleading information you provide through this website.

12. Cancellation, Fees & Disputes

HealthPro Matcher is completely free to consumers. We do not charge you any fee to use this website or to be matched with a provider. Because there is no charge to consumers, there are no consumer payments to refund and no subscriptions or purchases to cancel with us.

You may stop using the service at any time, and you may withdraw your request or opt out of further contact by following the instructions in Section 4 or by contacting us at info@healthpromatcher.com. Any fees, payment terms, billing, cancellation policies, or refunds relating to services you obtain are determined solely by the independent Third-Party Provider you engage, and any dispute about those services, charges, or refunds must be resolved directly with that provider.

13. Dispute Resolution & Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.

The parties agree to first attempt to resolve any dispute informally by contacting info@healthpromatcher.com. To the extent any dispute is not otherwise resolved, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California for the resolution of any such dispute. Nothing in these Terms limits either party's ability to bring an individual claim in small claims court where the claim qualifies.

14. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we may provide additional notice on the website. Your continued use of the website following any posted changes constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must discontinue use of the website.

15. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions, which shall continue in full force and effect.
